These Terms of Use (“Terms”) govern your access to and use of the doublewingbison.com website (the “Site”), which is owned and operated by Double Wing Bison Inc. (“Double Wing Bison,” “we,” “us,” or “our”), a for-profit corporation organized under the laws of the Commonwealth of Kentucky. The Site is an informational and marketing website that shares information about our company, our Thoroughbred breeding operation, and the products we offer, including the More Than Conquerors application.
Please read these Terms carefully. They apply only to the doublewingbison.com website. The More Than Conquerors mobile application is governed by its own separate terms, available at https://morethanconquerors.app/terms, and not by these Terms.
1. Acceptance
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, please do not use the Site. We may update these Terms from time to time as described in the “Changes” section below, and your continued use of the Site after an update takes effect constitutes your acceptance of the revised Terms.
2. Permitted use and conduct
You may use the Site for lawful, personal, and informational purposes in accordance with these Terms. You agree not to use the Site in any way that violates applicable law or regulation, infringes the rights of others, or interferes with the operation of the Site.
In particular, you agree that you will not:
- Disrupt, damage, overload, or impair the Site or the servers or networks that support it, or attempt to gain unauthorized access to any part of the Site or related systems.
- Introduce viruses, malware, or other harmful code, or engage in any activity intended to probe, scan, or test the vulnerability of the Site.
- Use any robot, spider, scraper, or other automated means to access, monitor, copy, or harvest content or data from the Site without our prior written permission, except for legitimate search-engine indexing.
- Use the Site to transmit unsolicited or unauthorized advertising, spam, or other solicitation, or to impersonate any person or entity.
- Remove, obscure, or alter any copyright, trademark, or other proprietary notices on the Site.
We reserve the right to investigate and take appropriate action, including restricting or blocking access to the Site, against anyone who, in our judgment, violates these Terms.
3. Intellectual property
The Site and its contents, including text, graphics, logos, images, photographs, layout, design, and other materials, are owned by Double Wing Bison Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws. “Double Wing Bison,” “More Than Conquerors,” and our related names, logos, and marks are trademarks of Double Wing Bison Inc. or our affiliates, and may not be used without our prior written permission.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to access and view the Site for your own informational purposes. This license does not permit you to copy, reproduce, distribute, modify, publicly display, create derivative works from, sell, or otherwise exploit any part of the Site or its contents except as expressly permitted by these Terms or applicable law. All rights not expressly granted are reserved.
4. Submissions
If you send us information through the contact form, by email, or otherwise in connection with the Site, you understand that we may use that information to read, route, and respond to your message and to maintain a reasonable record of our correspondence, as described in our Privacy Policy.
Please do not send us confidential or proprietary information that you expect us to keep secret, and please do not send us unsolicited creative ideas, suggestions, proposals, or materials. Any such unsolicited submissions are made without any expectation of confidentiality or compensation. To the extent you send us unsolicited ideas or suggestions, you agree that we are free to use them for any purpose, without restriction or obligation to you, and you represent that you have the right to share them with us.
5. Third-party links and the More Than Conquerors app
The Site may contain links to third-party websites, applications, or resources, including the More Than Conquerors application. These links are provided for your convenience only. We do not control and are not responsible for the content, products, services, privacy practices, or availability of any third-party website or resource, and a link does not imply our endorsement of it. Your use of any third-party website or resource is at your own risk and is subject to that third party’s own terms and policies.
The More Than Conquerors application is a separate product with its own terms of use, available at https://morethanconquerors.app/terms. These Site Terms do not govern your use of the More Than Conquerors application.
6. Disclaimers
The Site and all content on it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, Double Wing Bison Inc. disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components. We make no warranty regarding the accuracy, completeness, reliability, or currency of any content on the Site, and we may change or remove content at any time without notice. You rely on the Site and its content at your own risk.
7. Limitation of liability
To the maximum extent permitted by applicable law, Double Wing Bison Inc. and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Site, whether based on warranty, contract, tort, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
8. Indemnification
You agree to indemnify, defend, and hold harmless Double Wing Bison Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
9. Governing law
These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Kentucky will have exclusive jurisdiction over any such dispute, and you consent to the personal jurisdiction of those courts, except where prohibited by applicable law.
10. Changes
We may modify these Terms from time to time. When we make changes, we will revise the effective date shown at the top of these Terms and post the updated version on the Site. Changes are effective when posted. Your continued use of the Site after any change means that you accept the revised Terms. If you do not agree to the revised Terms, you should stop using the Site.
